Do Tribes Without Federal Recognition Have Rights?

Federal recognition creates a relationship with the U.S. government. It is not the source of a people's identity, its rights, or its jurisdiction.

Short answer

Yes. Federal recognition is a formal relationship with the United States government, and it carries specific federal programs and protections. It is not where Indigenous rights come from. Under ADRIP and UNDRIP, Indigenous peoples hold rights as peoples, and self-identification is a fundamental criterion for who the declarations apply to.

What federal recognition is

As of January 2024, the Bureau of Indian Affairs listed 574 federally recognized tribes (Congressional Research Service, R47414). The CRS describes three routes to federal recognition: the Department of the Interior’s administrative Federal Acknowledgment Process, an act of Congress, or a decision of a U.S. court. Recognition establishes a government-to-government relationship with the United States and eligibility for federal programs.

What federal recognition is not

Recognition acknowledges a people; it does not create them. The same is true of state recognition. As the Aboriginal Ministry of Justice puts it, state recognition may acknowledge a relationship, but it does not create jurisdiction. Jurisdiction exists through a nation’s own governance systems and authority.

The Xi-Amaru Republic does not seek U.S. federal recognition. It is an Indigenous autonomous self-governing nation that operates cooperatively alongside U.S. jurisdiction, as Amexum, its Indian country. See Federal Recognition and Indigenous Jurisdiction for the full discussion.

Where rights do come from

What the declarations say
“Self-identification as indigenous peoples will be a fundamental criterion for determining to whom this Declaration applies.”
“Indigenous peoples have the right to self-determination.”
Self-government
“Indigenous peoples, in exercising their right to self-determination, have the right to autonomy or self-government in matters relating to their internal and local affairs, as well as ways and means for financing their autonomous functions.”
“Indigenous peoples, in exercising their right to self-determination, have the right to autonomy or self-government in matters relating to their internal and local affairs, as well as ways and means for financing their autonomous functions.”

The declarations do not ask whether a people holds federal recognition. They ask whether the people identifies as Indigenous and maintains its own institutions. See Where Rights Come From and Inherent Sovereignty.
